Terms of Service
Last Updated: March 2025
1. Acceptance of Terms
By engaging Seculence for any security service, submitting our contact form, or using this website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or website.
2. Services Provided
Seculence provides offensive cybersecurity services including penetration testing, vulnerability assessments, red teaming, website security auditing, and security consulting. The specific scope, deliverables, and timeline of any engagement are defined in a Statement of Work (SoW) or written agreement signed by both parties prior to commencement.
3. Client Obligations
- You must provide written authorisation for all testing scope before work begins.
- You are responsible for obtaining any third-party authorisations required (e.g., cloud providers, ISPs).
- You must ensure you have the legal right to authorise testing on all assets in scope.
- You must not use Seculence's findings or reports to conduct illegal activities.
4. Authorisation and Scope
All penetration testing and security assessments are conducted under explicit written authorisation. Testing is strictly limited to the agreed scope. Any out-of-scope findings will be reported but not actively exploited. Seculence reserves the right to cease testing immediately if unexpected risks to third parties are identified.
5. Confidentiality
All findings, reports, and client data are treated as strictly confidential. Seculence will not disclose any client information, vulnerabilities, or engagement details to third parties without prior written consent, except where required by law. Clients are encouraged to sign a mutual NDA before sensitive engagements commence.
6. Intellectual Property
Upon full payment, clients receive a non-exclusive licence to use deliverables (reports, recommendations) for their internal security purposes. Seculence retains ownership of all methodologies, tools, frameworks, and proprietary techniques used during engagements. Generic, non-client-specific knowledge gained during engagements may be used by Seculence to improve its services.
7. Payment Terms
Payment terms are defined in the individual engagement agreement. Invoices are due within the agreed period from date of issue. Seculence reserves the right to withhold delivery of final reports until payment is received in full.
8. Limitation of Liability
Seculence's liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific engagement giving rise to the claim. Seculence is not liable for indirect, incidental, or consequential damages. Security assessments are point-in-time evaluations and do not guarantee the absence of all vulnerabilities.
9. No Guarantee of Security
While we strive to identify all vulnerabilities within scope, no security assessment can guarantee 100% coverage. The cybersecurity landscape evolves rapidly, and new vulnerabilities may emerge after an assessment. We recommend regular reassessments and continuous monitoring.
10. Website Use
This website is provided for informational purposes only. You may not attempt to probe, scan, or test the vulnerability of this website without written authorisation from Seculence. Unauthorised access attempts may constitute a criminal offence under applicable law.
11. Third-Party Links
This website may contain links to third-party websites. Seculence is not responsible for the content, privacy practices, or security of any external sites.
12. Changes to These Terms
We may update these Terms of Service periodically. Material changes will be noted by updating the "Last Updated" date. Continued use of our services after changes constitutes acceptance of the updated terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
